License fees

The photo manufacturer in principle has the right to exploit his work in any provided kind of the copyright law. It can allow him by issuing an authorization to use someone third (for example, a publisher or a magazine). The publication fee (license fee) may vary depending upon the type (eg. advertising, editorial article, etc.), the periphery (eg. circulation, distribution, size of image, etc.) and duration (eg. temporally unrestricted use on the Internet, etc.) of using,

In all cases of publications of photographic works must be clear that this is not about the purchase of a print or a scan, but that impression fees purely refer on the use of a motif – it´s abaut "intellectual property"!

The "Online Law" § 18a UrhG

Does the reproduction right, the right of distribution and the exploitation on the Internet. The amendment to the Austrian Copyright Act 2003 relates primarily to the interactive use of works on the Internet or with use of processes such as Link ratios and Downloads. The "Online Law" considered the problems associated with the Internet ways to make the public works independent of each other in different places and at different times "accessible".

With respect to the photographic copyright allowed without consent of the author / creator of (or rights holder) protected works not used on the Internet, nor be permanently incorporated into a database and reproduced from this (Downloads). Electronic storage is permitted only for the duration of the processing within the agreed use. Any change (color adjustments, sharpening, etc. of course excluded) and transformation of the pictures is only with the written consent of Ursula Röck allowed.

Digital image data are to be deleted after the exercise of the rights of use granted by all computers and external storage devices of the user. Moreover, the terms and conditions apply. Each use of a work on a website must be explicitly authorized by the copyright holder for the use of the Internet by the author Ursula Röck. This also applies to photographic works from the "pre-internet time" that have arisen under an earlier agreement (eg. authorization to use for printing in a catalog or magazine).

Each approved by Author publication shall be designated © Ursula Röck (directly from the image, or at least clearly assigned). When using the Internet this manufacturer's designation is to be executed as a link to www.ursularoeck.com. The omission of the manufacturer name is charged with a 100% premium to the agreed picture fee.

For Orientation on the publication fees, I refer to the publication "Image fees 200x - publication fees for commercial photography in Austria" in a brochure, which is published by the National Guild of Professional Photographers.
